In 1948, W. R. and Dessie Freeman (Albert Freeman's parents) conveyed to Cherokee Water Company 48-1/2 acres. Dessie Freeman died in 1987, and W. R. Freeman died in 1994. Since that time, the Freeman family and Cherokee have had several disputes regarding the property. See Cherokee Water Co. v. Freeman, 33 S.W.3d 349 (Tex. App.—Texarkana 2000, no pet.); Freeman v.
