On June 20, 2002, the United States Supreme Court decided that execution of the mentally retarded constitutes cruel and unusual punishment and is therefore prohibited by the Eighth Amendment to the United States Constitution. Atkins v. Virginia, 536 U.S. 304,122 S.Ct. 2242,153, L.Ed. 2d 335 (2002). As a result, numerous hopeful death row inmates have engaged in exhaustive research and reexamination of their trial records to determine whether the issue of mental retardation was raised. Many who claim it was raised are now applying for leave to seek post-conviction relief. This case involves one such death row inmate.
